Modern moral and political philosophy is in debt with natural law theory, both in its ancient and mediaeval elaborations. While the very notion of a natural law has proved highly controversial among 20th Century scholars, the last decades have witnessed a renewed interest in it. Indeed, the threats and challenges as result of multiculturalism, plural societies and global changes have generated a renewed attention to natural law theory. Clearly, it offers solid basis as possible framework to a better understanding of (...) human goods without contradictions and partial bias. The purpose of the present volume is to provide an overview of the history of this concept (Cicero, St. Paul, Aquinas, Melanchthon, Montaigne, Descartes, Leibniz, Hume, Burke, Kant, MacIntyre, etc.) as well as a deep understanding of ongoing research, both in Europe and in America. Furthermore, the specificity of these studies will be of particular value to philosophers, law-philosophers, historians, anthropologists, sociologists and theologians, and those concerned on such issues as the relation between law and moral norm, law and practical reason, and the presence of the idea of natural law in several prominent thinkers. It includes a selected bibliography on natural law. The book also provides an excellent introduction to several of the major topics in natural law theory making it useful both as a reference text and as a sourcebook for academics alike. Natural law is a rich, complex, and highly disputed term. Since its first appearances in the history of Western civilization, it has been used both to point to God as the source of the moral order and to assert that there is an objective order of justice in nature that men and their laws ought to respect. In modern times, natural law theory gave birth to what we usually call "human rights." Unlike the meaning of the term, the importance of an ongoing debate on natural law and on the theories related to it is undisputable. This is why I welcome today this new collection of essays edited by Alejandro Nèstor Garcìa Martìnez, Mario Å ilar and Josè M. Torralba. Natural Law: Historical, Systematic and Juridical Approaches includes a wide variety of studies, covering key authors and issues in natural law theory. Younger students will appreciate the clarity of the chapters, and more trained readers the detailed and accurate bibliographical references that each of them offers. The editors's choice to go from a historical approach to contemporary theories, and then to theoretical and more practical issues is also commendable. ResumoAs práticas culturais fundem, a todo o momento, diferentes relações entre sistemas culturais (EVEN-ZOHAR, 1990) que antes eram separados. Tais manifestações híbridas reconfiguram e desterritorializam processos simbólicos. Nesse sentido, o presente artigo realiza uma análise comparatista das relações intertextuais presentes na configuração artística do álbum Esú, do rapper brasileiro Baco Exu do Blues, em especial na faixa “Capitães de Areia” em relação ao romance quase homônimo de Jorge Amado, às referências à mitologia dos Erês, e à série fotográfica Laróyè, de (...) Mario Cravo Neto. Para analisar as implicações dessas inter-relações na configuração cultural e identitária da obra, buscamos aporte teórico-crítico no campo dos Estudos Culturais pela perspectiva de conceitos que tentam dar conta desses processos, acerca do Hibridismo, em Néstor García Canclini, e das reflexões sobre sincretismo religioso em Sérgio Ferretti.Palavras-chave: Capitães da Areia; Hibridismo; sincretismo religioso; práticas culturais. AbstractCultural practices merge, at all times, different relationships with cultural systems (EVENN-ZOHAR, 1991) that were previously separated. Such hybrid manifestations reconfigure and deterritorialize symbolic processes. In this sense, this article performs a comparative analysis of the intertextual relations present in the artistic configuration of the album Esú, by rapper Baco Exu do Blues, especially the track “Capitães de Areia” and references to the mythology of the Erês, to the novel by Jorge Amado and Laróyè photographic series by Mario Cravo Neto. To analyze the implications of these interrelations in the cultural and identity configuration of the work, we seek theoretical-critical support in the field of Cultural Studies from the perspective of concepts that try to account for these processes, about Hybridism in Néstor García Canclini and reflections on religious syncretism in Sérgio Ferreti.Keywords: Capitães da Areia; Hybridity; religious syncretism; cultural practices. There are two possible realist defense strategies against the pessimistic meta-induction and Laudan’s meta-modus tollens: the selective strategy, claiming that discarded theories are partially true, and the discontinuity strategy, denying that pessimism about past theories can be extended to current ones. A radical version of discontinuity realism is proposed by Gerald Doppelt: rather than discriminating between true and false components within theories, he holds that superseded theories cannot be shown to be even partially true, while present best theories are demonstrably (...) completely true. I argue that this position, running counter both the cumulativity of science and fallibilism, is untenable; it cannot account for the success of past theories, nor for the failures of current theories, and rather than shutting the door to the pessimistic historical objections it opens it wide. The best strategy, instead, joins the selective idea there was both some truth and some falsity in discarded theories, like in current ones, with the moderate discontinuity idea that the truth rate in present best theories is much greater than in past ones. The contrast between the past-future symmetry of mechanical theories and the time-arrow observed in the behaviour of real complex systems doesn’t have nowadays a fully satisfactory explanation. If one confides in the Laplace-dream that everything be exactly and completely describable by the known mechanical differential equations, the whole experimental evidence of the irreversibility of real complex processes can only be interpreted as an illusion due to the limits of human brain and shortness of human history. In this work it is (...) surmised that in the description of real events it would be more reasonable to renounce exactness and completeness of mechanical differential equations, assuming that also further effects exist in nature, governed by different kinds of rules, in spite of being so weak to be directly unobservable in single motions. This surmise can explain not only the time-arrow, but also why, in particular cases, it can happen that approximate and/or statistical models represent an improvement of mechanical theories instead of an approximation: this happened for Boltzmann gas-model and also for the famous work of Max Planck on blackbody-radiation. And it also appears as a more promising “working hypothesis”, stimulating and guiding us to learn more about limits and origin of the basic equations, and also about the nature of chance and the meaning of probability, which is nowadays not clear in spite of the fundamental role it plays in physics. Particularly that kind of probability which gives the connection between quantum–mechanical differential equations and observable events. (shrink)

This text is based on a reflection on the context and meaning of Maurice Merleau-Ponty’s visit to Mexico in February-March 1949 and the lectures he gave at the Faculty of Philosophy and Letters of the National Autonomous University of Mexico (UNAM). I rely on the information, analysis and notes of Merleau-Ponty that Michel Dalissier offers us in his book Inédits I-II. I devote myself particularly to commenting on the cultural experience that this trip represented for Merleau-Ponty – his relationship with (...) the Mexican philosophy of the Hiperión group – as well as his conception of culture and the relationship between cultures that he exhibits at the time and in the general construction of his own work and philosophy. I support the thesis that the question of a plurality of cultures and interculturality can only be thought in a rigorous way – without falling into cultural relativism or an abstract universalism – through a phenomenological-existential reformulation of the « universal, » as Merleau-Ponty outlines it in the Mexico Conferences. In contrast to Capra’s interpretation of Maturana’s work, I argue that the autopoietic theory does not establish an intrinsic, necessary link between life and cognitive/mental phenomena, and that given its functionalist approach, the theory helps very little to overcome the Cartesian division between mind and body.

L'autore parte dall'analisi dei problemi etici espressi nei linguaggi della poesia, della tragedia e della storiografia, per passare poi alla lettura delle maggiori opere del pensiero antico, fornendo di ognuna puntuali introduzioni. Un'attenzione particolare, alla fine di ogni capitolo, è dedicata all'eredità moderna e al significato attuale dei problemi dell'etica antica, proponendo in modo esplicito un collegamento fra ricostruzione storica e discussione teorica contemporanea.

Este artigo procura apresentar algumas considerações acerca do entrecruzamento do pensamento político de Hannah Arendt e a questão ambiental. Para tanto, o seguinte questionamento servirá de guia para a reflexão aqui pretendida: se o âmbito natural é perturbado pelas ações humanas, é razoável a crença de que a própria ação humana possa ser capaz de frear o atual cenário de catástrofe? Assim sendo, assume-se, aqui, como procedimento metodológico uma análise bibliográfica que recorre ao livro A condição humana (The human condition, (...) 1958 [2010]) e alguns ensaios da coletânea Entre o passado e o futuro (Between Past and Future, 1961 [2009]). De modo geral, busca-se desenvolver o argumento de que embora não se possa enquadrar Hannah Arendt no rol das “historiadoras das ciências”, tampouco uma “pensadora da ecologia”, é certo que ela nunca deixou de se interessar e comentar os eventos científicos de seu tempo, bem como de se preocupar com as consequências das ações humanas. Logo, os assuntos relacionados aos avanços tecnológicos e científicos constituem assuntos de primeira grandeza e importância tanto para o mundo quanto para a política. Em suma, pretende-se sustentar a hipótese de que para Hannah Arendt, a imagem adotada da natureza – ao menos desde a época moderna –, e as ações humanas cometidas a partir desta compreensão, afetam diretamente nossa existência política. Background The perception of organ donation and brain death among Syrian population has not been previously explored. The goal of this study is to evaluate the attitude and knowledge of organ donation among Syrians and the willingness of this population to donate their organs. Methods We conducted a survey-based cross-sectional study in four hospitals in Aleppo, Syria in November 2019. Patient demographic, awareness of brain death; and attitude toward organ donation were collected and analyzed. Results A total of 350 individuals (...) were invited to participate in the survey among whom 303 agreed to participate in the study. The majority of our participants heard about organ donation with television, social media, and the internet being the most common sources of information. When assessing knowledge about brain death, only 40% answered 3 or more questions correctly. Fifty-eight percent of respondents agreed with the idea of organ donation and 183 would like to donate their organs one day. The leading motivation to organ donation was the desire to help, while the most common reason to refuse donation was the refusal to disfigure a dead body by removing an organ. Religious reasons were cited as motivation for organ donation by 43% of participants, and a reason for refusing to donate organs by 24%. Most respondents were unaware of the laws and legislations related to organ donation in Syria. When asked if religion and law were encouraging organ donation, 76% of respondents would donate their organs. Although more positive attitude was found in those with better brain death knowledge, this did not translate into more willingness to donate organs in this group of participants. Conclusions The promotion of organ donations from deceased donors is a necessity given the rising shortage of organs. The information provided by this study could help policy makers build future strategies to promote deceased organ donation programs and overcome current obstacles preventing such initiatives from achieving their goals. Research using Controlled Human Infection Models is yet to be attempted in India. This study was conducted to understand the perceptions of the lay public and key opinion makers prior to the possible introduction of such studies in the country. 110 respondents from urban and rural Bangalore district were interviewed using qualitative research methods of Focus Group Discussions and In-depth Interviews. The data was analyzed using grounded theory. Safety was a key concern of the lay public, expressed in terms of (...) fear of death. The notion of infecting a healthy volunteer, the possibility of continued effects beyond the study duration and the likelihood of vulnerable populations volunteering solely for monetary benefit, were ethical concerns. Public good outcomes such as effective treatments, targeted vaccines and prevention of diseases was necessary justification for such studies. However, the comprehension of this benefit was not clear among non-medical, non-technical respondents and suggestions to seek alternatives to CHIMs repeatedly arose. There was a great deal of deflection—with each constituency feeling that people other than themselves may be ideally suited as participants. Risk takers, those without dependents, the more health and research literate, financially sound and those with an altruistic bent of mind emerged as possible CHIM volunteers. While widespread awareness and advocacy about CHIM is essential, listening to plural voices is the first step in public engagement in ethically contentious areas. Continued engagement and inclusive deliberative processes are required to redeem the mistrust of the public in research and rebuild faith in regulatory systems. (shrink)

Considering Butler's "tragic trilogy"-a set of interventions on Sophocles' Antigone, Euripides' Bacchae, and Aeschylus's Eumenides-this book seeks to understand not just how Butler uses and interprets Greek tragedy, but also how tragedy shapes Butler's thinking, even when their gaze is directed elsewhere. Through close readings of these tragedies, this book brings to light the tragic quality of Butler's writing. It shows how Butler's mode of reading tragedy-and, crucially, reading tragically-offers a distinctive ethico-political response to the harrowing dilemmas of our current (...) moment. (shrink)

Criticisms à la Laudan can block the “no miracles” argument for the (approximate) truth of whole theories. Realists have thus retrenched, arguing that at least the individual claims deployed in the derivation of novel predictions should be considered (approximately) true. But for Lyons (2002) there are historical counterexamples even to this weaker “deployment” realism: he lists a number of novel predictions supposedly derived from (radically) false claims. But if so, those successes would seem unexplainable, even by Lyons’ “modest surrealism” or (...) other surrogates to realism. In fact, I argue, some of those predictions were an easy guess, or independently probable in the light of available evidence; hence, they are no counterexamples to deployment realism, for the no miracles argument wouldn’t apply to them. In other instances, pace Lyon, the prediction was actually false, and could be reinterpreted as true only by interpreting as true also the claim from which it was derived; or again, a false claim was employed in the derivation of a true prediction, but inessentially, the essential role being played by a weaker true claim. But as soon as the paradoxical air of such historical cases is explained away in any of these manners, they cease to represent counterexamples to deployment realism. If, as I suggest, all of them can be dealt with by these strategies, a theoretical claim can still be assumed to be true if it is crucial in deriving an improbable novel prediction. (shrink)

The currently most plausible version of scientific realism is probably “deployment” realism, based on various contributions in the recent literature, and worked out as a unitary account in Psillos. According to it we can believe in the at least partial truth of theories, because that is the best explanation of their predictive success, and discarded theories which had novel predictive success had nonetheless some true parts, those necessary to derive their novel predictions. According to Doppelt this account cannot withstand the (...) antirealist objections based on the “pessimistic meta-induction” and Laudan’s historical counterexamples. Moreover it is incomplete, as it purports to explain the predictive success of theories, but overlooks the necessity to explain also their explanatory success. Accordingly, he proposes a new version of realism, presented as the best explanation of both predictive and explanatory success, and committed only to the truth of best current theories, not of the discarded ones. Here I argue that Doppelt has not shown that deployment realism as it stands cannot solve the problems raised by the history of science, explaining explanatory success does not add much to explaining novel predictive success, and a realism confined to current theories is implausible, and actually the easiest prey to the pessimistic meta-induction argument. RESUMO: O presente artigo tem por objetivo investigar a recepção do Tratado Teológico-Político de Espinosa, bem como sua crítica da religião pelo Marquês de Sade, numa obra bastante peculiar e que desafia todas as tentativas de classificação: La Philosophie dans le Boudoir. Em seu "Quinto Diálogo", Sade insere um texto intitulado "Franceses, mais um esforço se quereis ser Republicanos". Através do emprego desse artifício metalinguístico - um livro dentro de um livro - a política é agora introduzida na alcova e (...) o leitor se dá conta de que a instrução de Eugénie não é meramente sexual, mas também uma educação filosófica e política. Por meio de sua crítica ao Cristianismo, na primeira seção do texto, Sade argumenta que a tirania e a superstição religiosa são âmbitos intimamente relacionados, e a teologia é um dos principais alicerces do poder político. ABSTRACT: This article aims to investigate the interpretation by the Marquis de Sade of Spinoza's Theological-Political Treatise. Sade's interpretation appears in a very peculiar work which defies all rigid attempts of classification: La Philosophie dans le Boudoir. In the "Fifth Dialogue", Sade inserts a pamphlet entitled "Yet another effort, Frenchmen, if you would become Republicans". Through the employment of a metalinguistic device - a book inside a book - politics is now introduced into the boudoir, and the reader becomes aware that Eugénie's education is not merely sexual, but also philosophical and political. Through his critique of Christianity in the first section of the pamphlet, Sade argues that tyranny and religious superstition are closely related and that theology is one of the main foundations of political power. El propósito de este artículo consiste en mostrar el carácter social del contractualismo de Fichte. Para realizar ese propósito se comienza examinando la conexión entre trabajo y ciudadanía como una condición de la legitimidad política. Luego se presenta esa conexión en el marco del siempre posible desarrollo histórico de la naturaleza humana. Por último, se indican las razones de la recepción de Fichte como un precursor del socialismo germánico.

O artigo apresenta uma reflexão sobre a guerra a partir de Carl Schmitt e Hannah Arendt. Para tanto, realiza-se um recorte na obra de cada autor. De Carl Schmitt, discute-se o livro O conceito do político (2009) que contém ainda A teoria do Partisan. De Hannah Arendt, restringe-se a Sobre a violência (2001), A promessa da política (2020), e alguns ensaios contidos em Entre o passado e o futuro (2009). Neste sentido, Carl Schmitt permite discutir o papel da inimizade para (...) a decisão acerca da guerra e como essa situação-limite, ao mesmo tempo, constitui e afeta a dimensão do político. Já Hannah Arendt permite delinear certos traços constitutivos das guerras modernas que escapam à preocupação central Schmittiana, sobretudo o perigo intrínseco da inimizade produzir não a intensificação do político, mas a eliminação da vida humana sobre à Terra. Trata-se, enfim, de pensar o efeito do avanço tecnológico no campo dos assuntos humanos e como essa tópica transforma o estatuto da guerra. (shrink)
